These Terms of Service (the "Agreement") govern your use of the Onysoft AI Gateway services (the "Service") provided by Onysoft Veri Merkezi A.Ş. ("Onysoft", the "Company", "we").

By registering for or using our services, you represent that you have read, understood and accepted these Terms of Service. If you do not accept these terms, please do not use our services.

api Service Description

Onysoft AI Gateway is a middleware service that provides access to the models of various AI providers (OpenAI, Anthropic, Google, Meta, Mistral, etc.) through a single API.

Our service includes:

• OpenAI-compatible API endpoint
• Access to multiple AI providers
• Billing in TRY
• Usage statistics and dashboard
• Technical support

1. Registration Requirements

• You must be over 18 years of age
• You must provide accurate and up-to-date information
• You must use a valid email address
• You may create only one account (multiple accounts are prohibited)

2. Account Security

• You are responsible for keeping your password and API keys confidential
• You are responsible for all activity that takes place on your account
• You must notify us immediately if you suspect unauthorized access
• We recommend rotating your API keys regularly

3. Account Suspension

We may temporarily or permanently suspend your account in the following cases:

• Violation of the terms of service
• Payment failure
• Suspicious or abusive activity
• Legal requirements

payments Payment and Billing

1. Pricing

• Our pricing is usage-based (charged per token)
• Current prices are published on our website and in the API documentation
• Prices are calculated in TRY based on the daily CBRT exchange rates
• Price changes are announced 7 days in advance

2. Balance System

• You must have a balance in your account to use our services
• Balance top-ups can be made by credit card, bank transfer or other supported methods
• Loaded balances are non-refundable (except where required by law)
• When your balance runs out, your API access is automatically stopped

3. Invoicing

• E-invoices are issued to our corporate customers
• Invoices are issued monthly
• Pricing is applied inclusive of VAT
• It is your responsibility to keep your billing information up to date

Prohibited Uses

If prohibited uses are detected, your account may be closed immediately and permanently, and legal action may be initiated.

copyright Intellectual Property Rights

1. Onysoft's Rights

The Onysoft AI Gateway service, its interface, logos, designs and all related intellectual property rights belong to Onysoft Veri Merkezi A.Ş. These rights are protected under the Turkish Law on Intellectual and Artistic Works and international agreements.

2. User's Rights

Rights over the content (outputs) you generate through the API are subject to the terms of the relevant AI provider and applicable laws. In general, you hold the right to use the outputs you employ for commercial purposes.

3. License

Under this agreement, you are granted a limited, non-exclusive, non-transferable license to use our services in accordance with these terms.

gavel Limitation of Liability

1. Service Warranty

Our services are provided "as is" and "as available". Although we aim for 99.9% uptime, we do not guarantee uninterrupted or error-free service. Scheduled maintenance will be announced in advance.

2. AI Outputs

We do not guarantee the accuracy, completeness or fitness for a particular purpose of the outputs generated by AI models. It is recommended that you verify AI outputs before using them for critical decisions.

3. Liability Cap

To the maximum extent permitted by law, our total liability in any case shall not exceed the amount you paid us within the 12 months preceding the relevant event. We are not liable for indirect, incidental, special or punitive damages.

link Third-Party Services

Our service uses the services of third-party AI providers (OpenAI, Anthropic, Google, etc.). These providers have their own terms of service and privacy policies.

We are not liable for interruptions, changes or errors in the services of third-party providers. Such situations may affect our service.

cancel Termination of the Agreement

1. Termination by the User

You may close your account at any time. To request account closure, contact our support team. Your remaining balance is non-refundable.

2. Termination by Onysoft

In the event of a violation of the terms of service, or for any reason, we may suspend or terminate your account, with or without prior notice.

3. After Termination

When your account is terminated, your API access is ended immediately. Your data may be retained for the legal retention periods and is then deleted.

edit_note Changes to the Terms

We may update these Terms of Service from time to time. Significant changes will be announced at least 30 days in advance by email or on our website. Continuing to use the service after the changes take effect means that you accept the updated terms.

balance Dispute Resolution

Disputes arising from this agreement are governed by the laws of the Republic of Türkiye. The Courts and Enforcement Offices of Istanbul shall have jurisdiction over disputes that cannot be resolved between the parties.

Should you experience any problem, we kindly ask you to first contact our customer service. Many issues can be resolved amicably.

article Other Provisions

• Severability: The invalidity of any provision of this agreement does not affect the validity of the other provisions.
• Waiver: Our failure to exercise any of our rights does not mean that we waive that right.
• Assignment: You may not assign your rights or obligations arising from this agreement.
• Entire Agreement: This agreement constitutes the entire agreement between the parties.
• Force Majeure: We are not liable for disruptions caused by events beyond our control such as natural disasters, war, terrorism or pandemics.
