Explicit Consent and Commercial Electronic Message Permission

This text has been prepared by Onysoft Veri Merkezi Sistemleri Yazılım Sanayi ve Ticaret A.Ş. (“Onysoft”) to obtain your explicit consent under Article 5(1) of Law No. 6698 on the Protection of Personal Data (“KVKK”) and your commercial electronic message approval under Law No. 6563 on the Regulation of Electronic Commerce and the Regulation on Commercial Communication and Commercial Electronic Messages.

This permission is requested on the Onysoft GPU Sharing Program application form with a separate box that is unticked by default. Permission is not deemed given unless you tick the box.

If you give permission, the following personal data is processed for the purpose described in this text:

1. (a)Identity: first and last name; for corporate applications, the name of the authorised person together with the organisation's title;
2. (b)Contact: e-mail address and telephone number;
3. (c)Preferences: your preferred language of communication and application type (individual or corporate);
4. (d)Permission record: the date and time the permission was given and withdrawn, the version of the text approved, IP address and browser information.

Under this text, your device's hardware information, job and usage records or the content of your requests are not used for marketing purposes.

If you give permission, you may receive messages about:

1. (a)promotions and news about Onysoft products and services;
2. (b)campaign, discount and promotion announcements;
3. (c)new models and features added to the Onysoft AI Gateway catalogue;
4. (d)new opportunities, events and announcements within the Onysoft GPU Sharing Program.

Messages are sent by e-mail and SMS. Onysoft may send them through its own e-mail infrastructure or through message delivery providers acting as data processors.

Informational messages such as the status of your application, changes to agreements or policies, security notices, mandatory version updates and account-related transaction notices are not commercial messages; they are sent independently of this permission as part of performing the participation agreement.

The processing under this text relies solely on your explicit consent (KVKK Art. 5(1)) and your commercial electronic message approval.

Where required by legislation, your approval and any opt-out are recorded in the Message Management System (İleti Yönetim Sistemi, İYS). To deliver messages, your data may be shared, only to the extent necessary for delivery, with e-mail and SMS infrastructure providers acting as data processors. Your data is not sold or rented to third parties for this purpose.

You can withdraw your permission at any time, without giving a reason and free of charge, by:

1. (a)using the “Withdraw permission” button on your GPU Sharing application page in the Dashboard;
2. (b)writing to info@onysoft.com from the e-mail address registered to your Onysoft AI Gateway account;
3. (c)opting out through the Message Management System where provided by legislation;
4. (d)using the opt-out method stated in any commercial message sent to you.

Your withdrawal is processed within the period set by legislation and at the latest within three business days; no commercial messages are sent to you after that. Withdrawal does not affect the lawfulness of processing carried out on the basis of the permission before withdrawal.

If you withdraw your permission, your permission and opt-out records are kept for the period prescribed by legislation as evidence in case of any future dispute.

Your communication preferences under this permission are kept for as long as your permission is valid. Permission and opt-out records are kept for the periods prescribed by the relevant legislation (for commercial electronic message approval records, at least three years from the end of the approval's validity), and are then deleted, destroyed or anonymised.

By ticking the optional box on the application form, you declare that you have read this text and that, of your own free will, you give explicit consent and approval for Onysoft to send you product, campaign and program announcements by e-mail and SMS and to process the personal data listed above for this purpose.
